Terms & Conditions

Please read these terms carefully before using our services. By booking with us, you agree to these terms.

1. Booking & Payments

All bookings require a deposit to confirm your reservation. The deposit amount varies by package and is typically 30% of the total tour cost.

Important: The remaining balance must be paid 60 days before your scheduled departure date.
  • We accept credit/debit cards, bank transfers, and mobile payments
  • All prices are in USD unless otherwise specified
  • Prices are subject to change without notice
  • A booking confirmation will be sent upon receipt of deposit

2. Cancellation Policy

We understand that plans may change. Our cancellation policy is designed to be fair while accounting for pre-paid expenses.

  1. 60+ days before departure: Full refund minus $100 administration fee
  2. 30-60 days before departure: 50% of deposit refunded
  3. Less than 30 days: No refund available
  4. No-show: Full tour cost forfeited
Travel Insurance: We strongly recommend purchasing comprehensive travel insurance to cover unforeseen circumstances.

3. Changes & Modifications

While we strive to deliver the exact itinerary described, circumstances may require changes.

We reserve the right to:

  • Modify itineraries due to weather, safety, or unforeseen circumstances
  • Substitute accommodations with equivalent or superior standards
  • Change transportation methods if necessary
  • Adjust activities based on availability

We will notify you of any significant changes as soon as possible.

4. Traveler Responsibilities

Travelers are responsible for:

  • Valid passports with at least 6 months validity beyond travel dates
  • Required visas and travel documents
  • Mandatory vaccinations and health requirements
  • Travel insurance coverage
  • Adherence to local laws and customs
  • Timely arrival for scheduled activities
Health & Safety: Inform us of any medical conditions, disabilities, or special requirements before booking.

5. Liability & Insurance

Mamayao Safaris acts as an agent for various service providers (hotels, transportation, activity operators).

Our liability is limited to:

  • Negligence in tour arrangement
  • Breach of contract
  • Failure to exercise reasonable care

We are not liable for:

  • Acts of God, natural disasters, or political unrest
  • Loss or theft of personal belongings
  • Personal injury except where caused by our negligence
  • Third-party service provider failures

6. Privacy & Data Protection

We are committed to protecting your personal information. Our Privacy Policy details how we collect, use, and protect your data.

By booking with us, you consent to:

  1. Collection of personal information for booking purposes
  2. Sharing necessary information with service providers
  3. Use of your contact information for tour updates
  4. Photography usage as outlined in our Privacy Policy

You have the right to access, correct, or delete your personal information.

7. Intellectual Property

All content on our website and marketing materials is protected by copyright and trademark laws.

You may not:

  • Reproduce, distribute, or modify our content without permission
  • Use our trademarks or logos without authorization
  • Scrape or copy website content for commercial use
  • Use our content to create competing services
Photography: Photos taken during tours may be used for marketing purposes unless you specifically opt-out.

8. Governing Law

These terms are governed by the laws of Kenya. Any disputes will be resolved through arbitration in Nairobi, Kenya.

  • Kenyan law applies to all bookings
  • Disputes resolved through arbitration
  • English is the official language for communication

We reserve the right to update these terms at any time. Continued use of our services constitutes acceptance of updated terms.
